When he learns Sergei has survived his pulls his glasses off in disbelief and the pencil is no longer behind his ear. After a cut away to the director and back to Gibbs again, the pencil has returned and remains there for the rest of the scene, including the black and white closing transition.

Character mistake: Ari tells Ducky and Gerald that if they lie or he suspects them of lying, he will shoot them in a ball-and-socket joint. Ari later shoots Gerald in the shoulder and mentions that next time it would be his knee. The knee is not a ball-and-socket joint. It is a hinge joint. The only other ball-and-socket joint in the human body is located in the hip. Ari is an educated Doctor and should know the difference. (00:24:00)

Revealing mistake: When the NCIS team were directed to the first video, McGee states that they were the first to view the video, however, the view counter on the video said 531,817 views. (00:06:40 - 00:07:15)
Factual error: There is a flashback scene in this episode, where a young, dejected Abby Sciuto is walking along railroad tracks after failing to give the bear back to Ricki. This scene starts with a shot of the railroad tracks, then pans up to Abby. It can be seen that the rails are laid on concrete sleepers, with modern steel clips holding the rails to the sleepers. Given that the flashback appears to take place when she was at least a couple of decades younger (i.e. the mid-1990s), such modern methods of construction wouldn't have been used. A period-accurate railroad track would have wooden sleepers, spikes and lighter rail. As such, it's obvious that the producers just went to the nearest railroad tracks and filmed the scene there.

Continuity mistake: When we see Gibbs and Dr. Ryan at Gibbs' house he places two mugs on the table. The mugs' positions change between shots. (00:16:10)
Answer: I hadn't seen the backdoor pilots yet but while it wasn't explicitly stated, at least onscreen, I heard somewhere Vivian got either fired from NCIS due to jeopardizing a case, got resigned from the agency, or transferred to the FBI.
